Recently, the Second District Court of Appeals reversed a decision in Moschella v. State of Florida. Here’s what happened:

  • Law enforcement seized Moschella’s electronic devices and got a search warrant on July 27, 2020.
  • But they didn’t actually search those devices until September 2020—way outside the legal time limit.
  • Florida law says a search warrant must be executed within 10 days of being issued, or it’s considered stale (invalid).
  • Moschella challenged this, but the trial court ignored it.
  • On appeal, the higher court sided with him, saying that his rights were indeed violated.

Why This Matters:
