What Are the Grounds for Divorce in Florida?

Irretrievably Broken

  • The person you make a claim against has been considered mentally incapacitated for at least three years before you file the claim.
  • A court-appointed committee agrees that the individual is mentally incapacitated.
  • You send a notice of the divorce to your ex-spouse’s closest relative or guardian.

If the mentally incapacitated individual does not have a guardian, the court will appoint one for the proceedings.
