How to Initiate Divorce 

Florida is a no-fault divorce state, meaning you only need to show that your marriage is irretrievably broken. No proof of wrongdoing required. 

The process typically begins when one spouse files a Petition for Dissolution of Marriage with the family court, outlining basic details like the marriage date, addresses, and any children involved. The other spouse is then formally served and given a set window of time to respond.

What's Needed to File for Divorce in Orlando 

Before you can file, Florida law requires that at least one spouse has lived in the state for a minimum of six months. You'll also need to file the completed petition, and pay the applicable filing fee. If children are involved, Florida also requires parents to complete a state-approved parenting course.

Beyond the paperwork, a few practical steps can make the process smoother:

What Must Be Settled in a Divorce

  • How marital property and debts will be divided (Florida uses “equitable distribution,” which means fair, not necessarily equal)
  • Whether either spouse will receive alimony
