Drug Charges Involving Controlled Substances & Prescriptions

We handle possession, distribution, trafficking, and conspiracy allegations involving street drugs and illegally obtained prescription medications. Our review focuses on what prosecutors allege happened, the substance and amount involved, and whether the evidence supports the charge.

You can call us about allegations involving:

  • Cocaine
  • Heroin
  • Marijuana
  • Fentanyl
  • Ecstasy
  • Crystal meth
  • Oxycodone
  • Xanax (Alprazolam)
  • Conspiracy to traffic
  • Other illegally obtained prescription drugs

Drug charges can range from misdemeanors to felonies. The classification and available penalties depend on the alleged conduct, controlled substance, and amount. State law separately prohibits possession and conduct involving selling, manufacturing, delivering, or possessing a substance with intent to sell, manufacture, or deliver it.

Manufacturing & Cultivation Allegations

State law prohibits manufacturing a controlled substance and possessing one with intent to manufacture it. Fla. Stat. § 893.13 classifies manufacturing-related allegations from a misdemeanor in the first degree to a felony in the second degree based on the substance’s statutory schedule.

Florida separately criminalizes manufacturing methamphetamine or phencyclidine and possessing chemicals identified by law with intent to manufacture either substance. Manufacturing methamphetamine or phencyclidine in a structure or vehicle where a child younger than 16 is present is a first-degree felony carrying a mandatory minimum five-year prison term.

How Florida Classifies Controlled Substances

Florida classifies controlled substances into five schedules in Fla. Stat. § 893.03. Schedule I substances have a high potential for abuse and no currently accepted medical use in the United States. Schedules II through V include substances with accepted medical uses and progressively lower abuse potential under the statutory framework. A substance’s schedule affects the available charges and penalties.

At Fighter Law, we analyze how the alleged substance’s classification affects your case. We review whether the substance and its statutory classification were correctly identified. When the evidence supports it, we challenge an improper classification.

Drug-Free-Zone Allegations in Orlando

State law enhances certain allegations involving sale, manufacture, delivery, or possession with intent when the conduct allegedly occurred within 1,000 feet of a protected location. These locations include schools, child care facilities, and public housing. A qualifying allegation can elevate the felony degree and add a mandatory minimum prison term.

We scrutinize the claimed drug-free-zone boundaries, the evidence used to establish the location, and any applicable marking requirements. Measurements and location evidence matter because the prosecution must support the protected-location allegation rather than merely assert that an offense occurred nearby.

Searches, Seizures & Drug Investigation Evidence

Drug investigations can involve searches, surveillance, and undercover operations. Prosecutors may seek to use alleged drugs, paraphernalia, or digital communications as evidence. How investigators obtained that evidence is a material issue in our review of your case.

We examine searches and seizures for constitutional violations. If evidence resulted from an unlawful search or seizure, we can file a motion to suppress asking the court to exclude it. We also review how physical items and communications were connected to you.

Driver-License Consequences After a Drug Conviction

A qualifying Florida conviction for possession, sale, trafficking, or conspiracy involving a controlled substance requires the court to direct the Department of Highway Safety and Motor Vehicles to suspend your driver license. This consequence follows a conviction, not an arrest or allegation. Court clerks must promptly report qualifying convictions to the department.

The suspension lasts six months or until you’re evaluated for and, when required, complete an approved drug treatment and rehabilitation program. Under Fla. Stat. § 322.271, a court can grant a business-purposes-only restricted license when it finds a compelling circumstance and you otherwise qualify.

Facing a Drug Possession Charge in Florida?

Possession can take two forms under Florida law:

  • “Actual,” meaning the substance was found directly on you
  • “Constructive,” meaning it was found somewhere you had access to and control over, such as your car or home

Depending on the type and amount of the substance, a possession charge can range from a misdemeanor to a serious felony. State law permits possession when a controlled substance was lawfully obtained from a practitioner or under a valid prescription. Prosecutors don’t have to prove that you knew the substance was in your possession. Instead, lack of knowledge is something your defense may need to raise and support.

Potential defenses include challenging an unlawful search or seizure, disputing whether you controlled the area where the drugs were found, or questioning whether the substance was properly identified as illegal. The right strategy depends on the facts of your case.

Florida Cannabis Possession & Delivery Thresholds

Fla. Stat. § 893.13(6)(b) classifies possession of 20 grams or less of cannabis as a first-degree misdemeanor. Possession of more than 20 grams is a felony. The weight alleged in the charging documents and supported by the evidence therefore affects the offense classification.

Fla. Stat. § 893.13(3) separately classifies delivering 20 grams or less of cannabis without payment as a misdemeanor in the first degree. We review whether the evidence supports the alleged weight, possession, and delivery conduct.

Defending Against Florida Drug Paraphernalia Charges

Drug paraphernalia allegations can involve possessing, selling, or distributing items claimed to be intended for drug use. Pipes, syringes, and scales are common examples, but these allegations are distinct from possession of a controlled substance. The item’s purpose and context are central to our review.

We examine the alleged intent behind your possession of the item, whether it has a legitimate use, and whether the evidence connects it to illegal drug activity. Those facts shape our defense strategy for the specific paraphernalia allegation.

Orange County Adult Drug Court & Alternative Sentencing Options for Drug Offenses in Florida

The Adult Drug Court is a voluntary, multidisciplinary program that uses graduated phases, drug testing, and judicial review. It includes diversionary, probationary, and post-plea tracks. Successful completion of a diversionary track can result in dismissal of qualifying drug-related charges.

We can evaluate whether an alternative resolution is available based on your charge and circumstances. When it is, we can advocate for that resolution by presenting relevant mitigating factors to the court.
