What Counts as a Cybercrime in Florida?
Broadly, a cybercrime involves the misuse of a computer, network, device, or online account, whether to gain unauthorized access, cause harm, or commit another criminal act using digital tools.
At Fighter Law, we defend clients against Florida cybercrime charges, including:
- Unauthorized access to a computer, network, or device
- Introducing malware or other harmful code into a system
- Altering, damaging, or destroying data, programs, or files belonging to someone else
- Phishing schemes or credential theft, including trafficking in stolen passwords or login information
- Doxing or unauthorized disclosure of someone's personal data
- Interference with critical infrastructure or utility systems
- Conspiracy tied to any of the above, or overlapping identity theft charges
Please note: Fighter Law handles cybercrime cases prosecuted under Florida state law. We do not take on federal cases.
Penalties for Cybercrime Convictions
The consequences of a cybercrime conviction in Florida will depend on the harm or losses a criminal act caused. Unauthorized access to a computer or network, for example, is often charged as a third-degree felony. Charges can be elevated to a higher felony degree when the financial loss involved crosses certain thresholds, when government systems are affected, or when victims suffer significant harm. Penalties can include state prison time, probation, substantial fines, and a permanent criminal record that can follow you well beyond the courtroom.
Because so much depends on the specific facts of your case, an early conversation with our team can help clarify what you may be facing and what can be done about it.
Contacted by Investigators or Served with a Subpoena? Here's What to Do.
How you respond in the early stages of a cybercrime investigation can shape the rest of your case.
If law enforcement contacts you or you receive a subpoena:
- Don't give a statement without a lawyer present. You have the right to remain silent, and it's in your best interest to use it until you've spoken with an attorney.
- Don't delete, wipe, or alter any devices or accounts. Doing so can create separate legal problems, even if you believe the material isn't relevant.
- Bring us any paperwork right away, including subpoenas, letters, or warrants, so we can start reviewing your situation immediately.
The sooner our team gets involved, the more we can do to protect you.
What Fighter Law Can Do for You
Cybercrime cases often come down to details: who had access to a device, what the data actually shows, and whether the evidence was gathered lawfully.
When you partner with us, we can do any of the following to protect your rights, freedom, and future:
- Challenging authorization and intent. We look closely at whether you had permission to access the system in question and whether prosecutors can truly prove you acted knowingly or willfully.
- Scrutinizing attribution. Shared devices, shared Wi-Fi networks, and spoofed addresses can all raise real doubt about who was actually responsible for the alleged conduct.
- Reviewing how the evidence was obtained. We examine whether search warrants were properly scoped and whether any digital evidence was collected unlawfully.
- Disputing loss and damage calculations. Since the amount of alleged loss can determine the severity of your charge, we take a hard look at how that number was reached.
- Bringing in independent digital forensics professionals to conduct a review and help clarify what the evidence does, and doesn't, show.
No matter the case, we prepare as though we may go to trial. Our readiness has allowed us to achieve numerous successful outcomes, which you can read about on our case results page.

Cyber Crime FAQs
Is Violating a Website's Terms of Service a Crime?
Not on its own. Prosecutors must prove specific legal elements to secure a conviction, and simply breaking a website's rules usually isn't enough to meet that standard.
Can Investigators Search My Entire Phone or Cloud Account?
Not without proper legal authority. Search warrants have to be specific about what they cover, and our team looks closely at whether a search went beyond what was legally allowed.
What if Multiple People Used the Same Device or Wi-Fi Network?
This is a common and important issue in cybercrime cases. We examine access logs, timestamps, and other digital records to raise doubt about who was actually responsible for the conduct in question.
