What Florida Gun Crimes Can We Defend Against?

Florida law regulates how and when people can possess, carry, and use firearms. Although the Second Amendment provides important constitutional protections, there are many circumstances where state law can impose criminal penalties for firearm-related conduct.

Fighter Law represents individuals charged with various Florida gun crimes, including:

  • Carrying a concealed firearm without the required authorization
  • Improper exhibition of a firearm or other weapon
  • Possession of a firearm by a convicted felon
  • Possession of a firearm during the commission of another offense
  • Aggravated assault involving a firearm
  • Aggravated battery involving a firearm
  • Armed burglary
  • Armed robbery
  • Other state firearm and weapons offenses

In many cases, firearm charges can be filed alongside other criminal allegations, which can make things especially complex and amplify the potential penalties.

Potential Penalties for Florida Gun Crimes

Gun crime convictions in Florida can result in life-changing criminal penalties. Depending on the specific offense, your criminal history, and whether a firearm was used during another crime, you may face any of the following.

  • Jail or prison sentences that can amount to decades and even life
  • Significant fines totaling $1,000 to $10,000 or greater
  • Felony convictions that remain on your criminal record
  • Lengthy periods of probation
  • Loss of your right to bear arms
  • Difficulty obtaining employment, housing, or professional licenses

Understanding Florida's 10-20-Life Law

One of the most significant sentencing laws that can apply to certain gun crimes in Florida is the state's “10-20-Life” law. It imposes mandatory minimum prison sentences for specific felony offenses involving the use or possession of a firearm.

Here are more details:

  • Ten years may apply if a firearm was possessed during the commission of certain qualifying felonies
  • Twenty years may apply if the firearm was intentionally discharged during the offense
  • Twenty-five years to life may apply if the discharge caused great bodily harm or death

Because these are mandatory minimum sentences, judges are often unable to impose a lesser sentence. However, the prosecution must still prove that the law applies to the specific facts of the case. Questions about whether a firearm was actually possessed, whether it was discharged, or whether the evidence supports the allegations can all be central to an effective defense.

At Fighter Law, our attorneys meticulously examine every aspect of the prosecution's case to determine whether mandatory sentencing enhancements are legally justified. By doing so and challenging unsupported allegations, we work to protect our clients' rights and future.

Potential Defenses Against Gun Crime Charges

Leveraging decades of experience and local court familiarity, we craft defenses that are tailored to our clients’ goals and the specific facts of their cases.

Depending on your situation, we may pursue these defenses or others to fight charges of a gun crime:

  • Challenging whether law enforcement conducted an unlawful search or seizure
  • Arguing that the firearm was discovered through a violation of your constitutional rights
  • Questioning whether the prosecution can prove knowing possession
  • Demonstrating mistaken identity or lack of involvement
  • Challenging witness credibility or conflicting testimony
  • Identifying weaknesses or inconsistencies in the prosecution's evidence
  • Raising lawful self-defense or defense of others when supported by the facts
  • Negotiating for reduced charges or alternative resolutions when appropriate

Our attorneys prepare every case with careful attention to detail and a trial-ready approach. We are willing to go the distance if it means achieving an ideal outcome for our clients. Visit our case results page to see what we’ve accomplished for the many people who have trusted in us.
