What is Parking and Security Like in Brevard County
We have never had problems with parking in Brevard County. It’s not a high-volume court house and they have street level parking in front of the complex. Every once in a while, it will be a busy day and you might have to park behind the building that is not paved. So you may need to plan for having to walk in the dirt a little bit or on grass.
Security is also not too bad. I’ve never had to wait for say more than five minutes to get through security. Once you are through, there are elevators and stairs to the right. If you need help finding a courtroom, you can look at the monitors or ask one of the Deputies.
Overall, to ensure a smooth and hassle-free visit to the Brevard County Courthouse, it’s a good idea to arrive early (30 minutes should be enough), especially if you have a scheduled court appearance or need to attend a specific hearing. Planning your trip in advance and allowing for some extra time to find parking will help alleviate any potential stress or delays.
Brevard Court Procedure
This is what you can expect in your criminal case in Brevard County:
Arraignment: The first court appearance is usually the arraignment. During this hearing, the charges against you will be read, and you will be asked to enter a plea of guilty, not guilty, or no contest. If you have legal representation, they will guide you through this process.
Pretrial Proceedings: Following the arraignment, there will be several pretrial proceedings. These include discovery, where both the prosecution and defense exchange evidence, and possible plea negotiations between your attorney and the prosecution. Pretrial motions may also be filed by either side, addressing legal issues that may affect the case.
Negotiations and Discovery: During this phase of your case, your attorney will be demanding the discovery from the prosecutor. Procedurally, you are entitled to know everything that there is against you in your case before you have to decide to go to trial – or take a plea. This includes taking depositions of all the witnesses, and seeing all of the physical and scientific evidence that may be available to the prosecutor. You can inspect all of the evidence and prepare to call witnesses to rebut any of it. During this, negotiations will be on going. For example, the prosecution might start with a higher offer (of prison, for example) until the defense poke holes in their case, making the realize that they may not have a strong a case as they once thought – causing them to lower their offer to probation. If the evidence is sufficiently attacked by the defence, the prosecution may even drop the case entirely.
Trial: If the case proceeds to trial, it will be held in the Brevard County Courthouse. Trials are always stressful and should be avoided wherever possible. Especially if you have never been arrested for anything in the past. On the other hand, sometimes zero unavoidable. But an experienced lawyer, to tell you your chances and the best- and worst-case scenarios. Criminal trials in Florida can be conducted by a judge (bench trial) or a jury. During the trial, both sides will present their case, including witnesses, evidence, and arguments. Your defense attorney will advocate on your behalf, challenging the prosecution’s evidence and presenting any applicable defenses.
Sentencing: If you are found guilty or choose to plead guilty or no contest, the court will proceed to the sentencing phase. The judge will consider various factors, including the nature of the offense, any prior criminal history, and mitigating or aggravating circumstances. The sentencing may involve fines, probation, community service, restitution, or, in some cases, incarceration.
Appeals: In case of an unfavorable outcome, you may have the option to appeal the decision. This process involves requesting a higher court to review the trial court’s decision for legal errors or other grounds that may warrant a reversal or modification of the judgment. It’s important to consult with your attorney to understand the specifics of the appellate process.
Throughout the court proceedings, it is essential to have legal representation. If you cannot afford an attorney, you may be eligible for a court-appointed lawyer. Your attorney will provide guidance, protect your rights, and advocate for you during the entire process.
It’s important to dress appropriately when attending court hearings. Dress in clean, professional attire, such as business or business-casual clothing. Avoid wearing revealing or offensive clothing, as it may create a negative impression.
