The Line Between Professional Massage Therapy and Sexual Assault: Seeking Justice for BF

Massage therapy is a well-respected profession that provides physical and mental relief to countless individuals. However, this profession, like any other, has clear ethical and legal boundaries. Clients seek massage therapy for relaxation, pain relief, and rehabilitation—not for unwanted sexual advances or violations of their personal space. A massage therapist is entrusted with their client’s body, and with that trust comes a fundamental duty of care and respect.

Unfortunately, that trust was allegedly violated in a horrifying manner when our client, BF, was sexually assaulted by Ronel Michael Gutierrez, a massage therapist at Romich Massage and Spa. According to BF’s allegations, Gutierrez used his position to perpetrate an egregious act of sexual misconduct by digitally penetrating him under the guise of a professional massage.

Understanding the Boundaries of Massage Therapy

Massage therapy is a structured practice that adheres to strict guidelines regarding client care. Licensed massage therapists are trained to maintain professional boundaries, ensuring that all physical contact is appropriate and therapeutic.

A legitimate massage may involve:

• The use of hands, elbows, or forearms to apply pressure to muscles.
• The manipulation of soft tissues to alleviate tension and improve circulation.
• Clear, professional communication about the client’s comfort level and boundaries.

A massage never includes:

• Any form of sexual contact, including digital penetration.
• Unwanted or unprofessional touch in areas outside of agreed-upon treatment zones.
• Coercion or abuse of power to manipulate or take advantage of a client.

When a massage therapist crosses these clear professional boundaries, it is not just unethical—it is criminal.

The Allegations Against Ronel Michael Gutierrez

BF, like many others, sought a massage for legitimate therapeutic purposes. He did not consent to any sexual contact, yet he alleges that Gutierrez engaged in non-consensual digital penetration under the pretense of treatment.

Sexual assault is a grave violation of an individual’s bodily autonomy. It is not a “misunderstanding” or “miscommunication” when a professional takes advantage of a client’s vulnerability and trust. If these allegations are proven true, Gutierrez’s actions represent a blatant abuse of power, violating not only ethical standards but also Florida law.
